SPEEDING TICKET
Hundreds of thousands of speeding tickets are given in Florida each year. Some people still do not realize that if you pay your speeding ticket it is an automatic admission and adjudication of guilt on your driving record. That means that points will be added on your license. If you accumulate too many points your driver’s license will be suspended. In addition, insurance companies use this information as a justification to raise your insurance rates.

MOTION TO DISMISS
In Florida a speeding ticket is a civil violation. First, your attorney will look at the charging document (the ticket itself) and check to make sure that it was filled out properly. Was it signed by you? Was it signed by the Officer? Was a valid statute cited?
Second, your lawyer will check which Florida statute section the officer used to determine if you are being properly charged. Florida has three different statutes dealing with speeding.
Then, your attorney will review the rules on the particular speed detection device that was used. There are several types of speed detection devices in use by police in Florida. Whatever the detection method, there are strict rules governing admissibility of evidence.
Finally, your lawyer will verify that all time deadline requirements were met. Was the ticket filed timely? Was your right to a speedy trial violated?
If a legal basis exists your attorney will file a Motion to Dismiss the case. If it is granted you will have no points, and no court costs.
PRE TRIAL
If your lawyer can not find a legal basis for a Motion to Dismiss he will appear on your behalf at the pre trial conference. He will talk to the hearing officer assigned to your case to try to negotiate a favorable disposition to your case that will allow you to avoid points on your license.
The negotiation may involve you paying court costs. If court costs are imposed our law office will let you know in writing. You will have thirty days to pay the court costs. If you have a very poor driving record, the hearing officer may also insist on Traffic School. If Traffic School is imposed you will have 180 days to complete the Traffic School.
TRIAL
If your case does make it to trial and the Officer fails to appear it will be dismissed. If he does appear, your attorney can cross examine the Police Officer, and help you present your case to the hearing officer in the best possible light.
However, there is a risk when you take a case to trial. You could be found guilty. If you are found guilty the hearing officer can impose: $500 in fine, High Risk Traffic School (32 hours), and points on your license. Therefore, at The Law Offices of Alexander B.
